Service terms

These terms explain the arrangements for business use of Drivaxo. They apply when supplied before the contract is concluded and accepted by the customer.

On this page

1. Your agreement

The customer is the business subscribing to Drivaxo. Anyone ordering on its behalf must have authority. The quotation or order confirmation sets out features, price, VAT, duration, payment, cancellation and any support commitments. Visiting this website or downloading the app does not, by itself, create a paid subscription.

Expressly agreed special terms take precedence. For personal data, the data processing agreement prevails in a conflict. The privacy policy informs individuals; it is not blanket consent to all processing. Keep the accepted version with your agreement.

2. The service and its limits

You receive a non-exclusive right to use Drivaxo for your business and authorised users. Drivaxo supports your administration; it does not replace a carrier contract, employment decision, statutory inspection or mandatory register.

Reminders and counters depend on entered data and configured deadlines. Check critical deadlines independently. A sending status does not prove that a carrier has accepted the substance of a reply. We do not guarantee dismissal of a complaint, avoidance of a fine or a particular business result.

A trial lets you assess the available features. Trial or beta limitations are disclosed in advance. Planned GPS features and other future extensions are not automatically included.

3. Accounts and responsible use

  • Allow access only to authorised people and remove it when no longer needed. Do not share passwords or personal accounts.
  • Enter accurate information and upload only data you may lawfully use. Do not submit identity-document or driving-licence copies or numbers, national-register numbers, employment contracts or medical files. Use the date fields for reminders and limit data to what the feature needs.
  • Do not use Drivaxo for deception, unlawful staff monitoring, spam, malicious software or access to another company’s workspace. Do not bypass access controls.
  • Use the app only when safe and lawful; never while driving. Statutory rights relating to interoperability, research and vulnerability reporting remain unaffected.

4. Email, complaints and external services

Connect only a mailbox your business is authorised to use. Agree in advance which complaint emails may be retrieved and which replies may be sent on your behalf. Keep permissions and contact details up to date. Drivaxo does not provide general access to employees’ private email.

If in doubt, check the case, entered facts and sending status. Drivaxo can prepare or send replies under the configured workflow; this does not authorise the addition of unsupported facts.

An external map, mailbox or future GPS service may have its own terms. We explain dependencies; these do not remove our own obligations. Where another supplier provides devices or installation, the parties separately agree who supplies, supports and warrants them.

5. Maintenance and changes

We provide the service with professional care and work to resolve reported faults. Maintenance, network problems or outages may affect availability. A specific availability or recovery time applies only if agreed in writing.

Where reasonably possible, we give advance notice of planned material changes. We do not retroactively reduce core services or change prices by silently editing this page. Where your agreement is required, we obtain it. Statutory and contractual termination rights remain available.

6. Payment and termination

Only agreed fees are payable. Prices, VAT, payment periods and any renewal must be clear before ordering. A new paid feature requires a separate agreement; this text contains no hidden renewals or penalties.

A material breach must be explained in writing and, where it can be remedied, allow a reasonable opportunity to remedy it. Suspension is limited to what is necessary. An immediate security risk or legal requirement may require faster action; we explain the reason when safe and lawful.

Ending the service does not mean immediate deletion of every record. We coordinate return and deletion with the authorised customer while preserving statutory rights and retention obligations.

7. Your data and our work

Your business retains its rights in the data it supplies. You grant us only the rights needed to deliver and secure the agreed service, not permission to sell your records or use them for advertising.

Drivaxo’s software, design and original texts remain the property of Drivaro or their respective rights holders. Open-source and third-party rights remain applicable. You may take your own data with you; the software licence does not transfer source code or our trade secrets.

Both parties keep non-public business information confidential, including after termination. Disclosure is limited to necessary authorised people or a legal requirement.

8. If something goes wrong

Report problems promptly so we can limit harm and investigate a remedy. Each party remains responsible for damage attributable to it under applicable law. An input error or a third-party outage does not remove our responsibility for our own fault.

These terms do not exclude liability for intentional misconduct, gross fault, personal injury or obligations that cannot lawfully be limited. They do not remove statutory compensation rights, including GDPR rights. Any additional liability arrangements must be expressly agreed and legally permissible.

9. Questions and disputes

Email [email protected] with your company name and a short description of your question or complaint. Do not send a password or full customer files. We investigate and work with you towards a solution.

Belgian law applies. Disputes are heard by the court competent under the applicable jurisdiction rules. Mandatory protections under other applicable laws remain unaffected.

Drivaxo is offered for business use. If you nevertheless qualify as a consumer in a particular relationship, applicable consumer rights remain in force, including information, withdrawal and conformity rights. An invalid term does not remove those rights.
